On April 28, 2025, the Court of King’s Bench of Alberta released its decision on a judicial review brought forward by individuals associated with Fair Future Canmore, challenging the validity of the Division of Class 1 Property Bylaw (the Livability Tax Program).
We are pleased that the court has upheld the bylaw, allowing us to move ahead with the Livability Tax Program starting in the 2026 tax year.

While encouraging primary residency, the Livability Tax Program will directly fund the creation of non-market homes. We look forward to this program moving forward with full legal authority behind us.”
